1. agreement to terms

By using Simple Habit Tracker ("the App"), you agree to these Terms of Service. If you don't agree, please don't use the App.

2. description of service

Simple Habit Tracker is a minimalist habit tracking application available in two tiers:

  • • Free: Up to 5 habits, 7-day history access, basic icons and colors, local storage only
  • • Premium: Unlimited habits, full history, analytics, premium customization, data export (CSV/JSON), iCloud sync across devices, and future features (Apple Watch app coming Q4 2025)

3. data storage and ownership

your data belongs to you

  • • All habit data you create is yours
  • • Free users: Data is stored locally on your device only
  • • Premium users:
  • - Data stored locally AND synced to your personal iCloud account
  • - Access to data export (CSV/JSON)
  • - iCloud sync across all your devices using the same Apple ID

data loss risk

  • • Important: Free users have no cloud backup. If you delete the App or lose your device, your data is permanently lost
  • • Premium users with iCloud sync: Your data is backed up to your iCloud account and synced across devices. However, we still recommend maintaining periodic exports as backups
  • • We are not responsible for any data loss, including iCloud sync failures or Apple service outages

4. premium subscriptions

payment and billing

  • • Subscriptions are charged through your Apple ID account
  • • Payment will be charged at purchase confirmation
  • • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
  • • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • • You can manage and cancel subscriptions in your App Store account settings

pricing

  • • Prices are subject to change with 30 days notice
  • • Price changes won't affect your current subscription period
  • • Existing subscribers will be grandfathered at their original price for active subscriptions

free trial

  • • New subscribers may be offered a free trial period
  • • If you cancel during the trial, you won't be charged
  • • If you don't cancel, you'll automatically be charged at the end of the trial

refunds

  • • Refunds are handled by Apple according to their refund policy
  • • Contact Apple Support for refund requests
  • • We don't control Apple's refund decisions

5. future features

Features marked as "Coming Q4 2025" (Apple Watch app) are planned but not guaranteed:

  • • Release dates may change
  • • Features may be modified or canceled
  • • Existing subscriptions remain valid regardless of feature timeline
  • • No refunds will be issued based on delayed or canceled future features

Currently available Premium features:

  • • iCloud sync (now available)
  • • All other features listed in the Premium tier

6. acceptable use

You agree NOT to:

  • • Reverse engineer, decompile, or hack the App
  • • Use the App for any illegal purpose
  • • Attempt to gain unauthorized access to our systems
  • • Share your Premium subscription with others
  • • Create fraudulent accounts or abuse trials

7. privacy

Your privacy matters to us:

  • • We don't track you
  • • We don't sell your data
  • • We don't show ads

Data storage by tier:

  • • Free users: All data stays on your device only
  • • Premium users:
  • - Data stored locally on your device
  • - Optionally synced to YOUR personal iCloud account via Apple CloudKit
  • - We do not have access to your iCloud data
  • - Only you can access your synced data

8. intellectual property

  • • Simple Habit Tracker and all its content are owned by Digital Doves
  • • You may not copy, modify, or redistribute the App
  • • Your habit data belongs to you, but the App itself is our property

9. disclaimer of warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND:

  • • We don't guarantee the App will always work perfectly
  • • We don't guarantee it will meet your specific needs
  • • We're not responsible for bugs, crashes, or data loss
  • • Use the App at your own risk

10. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • • We're not liable for any indirect, incidental, or consequential damages
  • • Our total liability won't exceed the amount you paid for Premium (if applicable)
  • • Some jurisdictions don't allow these limitations, so they may not apply to you

11. changes to terms

We may update these Terms:

  • • We'll notify you of significant changes via the App or email
  • • Continued use after changes means you accept the new Terms
  • • If you don't agree with changes, cancel your subscription and stop using the App

12. account termination

We may terminate or suspend your access if:

  • • You violate these Terms
  • • You engage in fraudulent activity
  • • Required by law

You may cancel your subscription at any time through your Apple account settings.

13. governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law provisions.

If any part of these Terms is found unenforceable, the rest remains in effect.

16. entire agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Digital Doves regarding the App.

By using Simple Habit Tracker, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
